The general definition of a divorce is the legal end of a marriage. Marriage is a legally-binding agreement, and if a husband and wife wish to end their marriage they must go through formal court proceedings. In Denver, Colorado, the process begins with the filing of a petition for dissolution of marriage. The only allowed grounds for divorce in our state is based upon the court finding that the marriage is irretrievably broken. This “no-fault” approach to divorce enables parties to file even in the absence of adultery, abandonment, imprisonment or abuse, which used to be the grounds upon which parties filed for divorce.

To successfully complete a divorce in Denver, both parties must reach an agreement regarding several key issues. This will include property division, spousal support and child support and custody if children are involved. Once a settlement is reached through negotiations or mediation or if a contested divorce is taken to a hearing before a judge to be resolved, the divorce can be finalized.

Only after a divorce is complete can the parties move on and remarry.

Divorce Statistics

According to the Centers for Disease Control and Prevention (CDC), there were 2,077,000 marriages in the United States in 2009, at a rate of 6.8 per 1,000 total population. The divorce rate the same year was 3.4 per 1,000 population (of 44 reporting states and the District of Columbia).

In Colorado, the CDC reports that the divorce rate was 4.4 per 1,000 in 2007. This rate was equal to the 3 previous years but has an overall downtrend from 1990, when it was 5.5.

Nevada had the highest divorce rate in 2007 with 6.5 and the District of Columbia had the lowest divorce rate in 2007, at 1.7.
