Marital Property Value Flexible

In dividing marital property, if the parties cannot agree, then a court must determine the the approximate current value of the property owned by the parties.  Contact the Divorce Help Center and let a professional mediator assist you in finding a fair resolution to this issues.  Otherwise, the determination of value is within the trial court’s discretion, and absent a clearly erroneous decision, the Court of Appeals will not overrule such a decision if it was reasonable in light of the evidence as a whole.  The court may base its ruling on the proposed values offered by either party OR determine on its own the reasonable value of the property as long as it gives any reasonable basis for its order.  Therefore, in almost all circumstances it makes more sense, both emotionally and financially, for the parties to arrive at a compromised but agreed upon valuation of the marital property.
